About the Proposed New Plymouth District Plan - Appeals Version


The period for making appeals to the Environment Court on the Proposed New Plymouth District Plan - Decisions Version has now closed. 

Council received 23 appeals on the Decisions Version of the Plan. All documents relating to these appeals have been uploaded to our Appeals page.

We have updated our EPlan and identified the provisions of the Plan that are subject to an appeal. Released on 14 September 2023, this version is called the Proposed District Plan – Appeals Version. Rules which are not subject to appeal are now treated as operative, pursuant to section 86F of the Resource Management Act 1991.

Parts of the plan that are under appeal are annotated with a red border and a red exclamation mark icon to the right-hand side of the provision:

By clicking on the red exclamation mark icon, you can find out who appealed that provision, and a link through to the relevant appeal documentation. Map-related appeals, for example appeals against zonings, overlay extents or mapped features, can also be identified on the planning map with a red polygon.

Please note that the provisions and features identified and annotated as subject to appeal have been derived from the appeals that were filed with the Environment Court and Council’s current understanding of the potential scope of relief sought. As appeals are resolved by mediation or court proceedings, or withdrawn, the parts of the Plan that are under appeal will change over time, meaning the Appeals Version is a ‘living’ document.

Generally, resource consents will be assessed using the Proposed New Plymouth District Plan – Appeals Version 2023. However, in some cases, provisions or planning maps that are subject to an appeal may be relevant and it may be necessary to apply for resource consents under both the Operative District Plan 2005 and the Proposed District Plan – Appeals Version 2023.

Applications involving two district plans can be quite complex and it is suggested that you consult a professional to assist you with any application for consent.

Proposed District Plan Timeline

The Proposed District Plan was notified in September 2019. 589 submissions were received, containing just under 8,000 submission points. All submissions can be found on our Submissions page.

Submissions received on the Proposed District Plan were heard by a Hearings Panel made up of four independent commissioners. Commencing in July 2021, the hearings ran over 14 months and were completed in September 2022. All submissions on the Proposed District Plan were addressed through a total of 23 hearing streams, held running over 72 hearing days.  All evidence and reports provided at the hearings is available under the relevant hearing stream topics along with the video recordings. Following the conclusion of hearings, the Commissioners deliberated on all the submissions and evidence received. The Hearings Panel’s recommended decisions on the submissions were presented to and adopted by Council on 2 May 2023. On 13 May 2023, the Proposed District Plan – Decisions Version was notified reflecting those decisions.

The period for making appeals to the Environment Court on the Proposed District Plan – Decisions Version ran from 13 May 2023 to 26 June 2023, and the period for lodging section 274 notices (to join an appeal) ended on 17 July 2023. On 14 September 2023, the Council released the Proposed District Plan – Appeals Version.
